Ex-charity worker accused of raping woman at footy party
Kingston man Andre "Dre" Adomaitis, 37, has pleaded not guilty to sexually assaulting and raping a woman at an NRL grand final party, the Beenleigh District Court heard on Monday.
Police allege Adomaitis was hosting a small party, of around ten people, at his house on October 1, 2017.
The court heard the alleged victim was in attendance and, of her own account, drinking heavily.
Photographs tendered to the court show the group hanging out in the garage and the woman sitting on Adomaitis's lap while laughing.
A witness told the court the party was a relaxed, social gathering where they were "having a feed, a good time, and having some laughs".
Police allege the gathering took a darker turn as the night wore on and everyone became more intoxicated, with witnesses describing how some partygoers passed out on the couch, another became ill, and cannabis was passed around.
The defence counsel asked witnesses whether the woman's behaviour had become "flirty" towards Adomaitis, and if she was giving him "cuddles", a suggestion they denied knowledge of.
Adomaitis invited the woman and another female attendee to stay the night in his room and told them he would sleep on the couch.
In the early morning hours the second woman decided to walk home as she was having difficulty sleeping, leaving the alleged victim alone in the bedroom.
The crown prosecutor told the court the woman woke to Adomaitis taking off her clothes and touching and licking her genitals.
She further alleged Adomaitis raped her.
The woman's mother told the jury about a phone call she received the following morning.
"Mum, I've been raped," the woman told her mother.
"She was crying, she was really, really upset," her mother told the court.
"I was taken aback."
The alleged incident was reported to police the following morning and the woman underwent medical examination at hospital.
Adomaitis is charged with two counts of sexual assault and one count of rape.
He denies the charges.
In a formal police interview, Adomaitis told police he had sexual intercourse with the woman, but believed it was consensual.
The jury is tasked with determining whether consent was granted.
Adomaitis is a former student of Marsden State High School and former manager at Sheltered by Grace, a not-for-profit organisation that provides shelter for the homeless.
The trial is ongoing.
